LEGAL POLICIES

1. RESERVATIONS & PAYMENTS

Planning ahead assures availability of travel dates as well as best airline rates. Group size is limited on scheduled group departures ( max 15 ) and some trips may sell out early. All tour reservations are made via the Online Booking Form with the following steps:

 

1) Complete the online form "Book Now" including your preferred timing, tick the Legal Policies box and send to CP                

2) CP will contact you by telephone and/or eMail to confirm your preferred timing or to discuss other timing alternatives            

3) When your tour timing is confirmed, CP will send an order confirmation to you by eMail which includes the tour offer, tour

   dates, and payment terms    

4) Once you have received the order confirmation, an initial payment of  400,00€  per person is due or  - if booked late - the full

    tour amount. You may transfer you payments directly to our bank account at BBVA, i.e., to Camino Partners,

   BIC: BBVAESMM

   IBAN:  ES42 0182 2910 2302 0152 7731 

   or using your credit card via PayPal ( Visa, Master Card, American Express )

5) CP confirms to you by eMail the receipt of your payment and - if applicable - the due date for the 2nd payment

6) The balance of your selected tour price is due 60 days prior to departure. As mentioned above, you may pay by money transfer or credit card.      If your tour is within 60 days of booking, the full payment is due immediately.

7) If the final payment is not paid when due, CP reserves the right to treat the reservation as cancelled, resulting in the loss of previous deposits

    and payments.

 

Changing your reservation. Up to 60 days prior to departure, you may change your reservation at no cost, depending on availability, from one tour departure date to another i.e., on the same itinerary and within the same season ( spring, summer, autumn, winter. ). Please notify in writing.

Tour prices may vary and they are based on hotel room double occupancy; single supplements  apply.

Documents. International travel may require not only a valid ID but a valid passport. The EU requires that the passport be valid a minimum of 3 months after your return trip. Therefore, before traveling, make sure you leave home with valid documents ( ID, passport, visa).

2. CANCELLATIONS

Itinerary Changes

CP reserves the right to alter a tour itinerary since the actual planning and  tour arrangements are made often long in advance, and unforeseen circumstances that mandate change may arise ( as in the case of extreme weather conditions ) . Itinerary changes are made to improve the tour as well as your CP tour experience.

 

Accomodation.

At CP we always try to organise hotel acccomodation which is in line with modern standards in comfort and tidiness. However, in rural areas along the Camino we may find only a limited availability of "quality hotels"; in such cases we will try our utmost to secure accomodation which is as close as possible to CP's hotel standards ( 4 to 3 star ). You understand and accept that accomodation standards in rural areas may vary from place to place and that such variations are an inherent potential of travels and related outdoor activities in less developed areas, and that CP will not assume responsibility whatsoever for any inconvenience caused by hotel bookings with a  lower than expected accomodation standard.

 

Cancelling your reservation.

You will have 2 weeks from the time of your original booking to cancel your reservation without being charged a cancellation fee if the tour was booked 60 days prior to departure date; otherwise the cancellation fee will be equal to the initial deposit of  400€.

 

If the cancellation takes place less than 30 days prior to the tour departure, the full tour price must be paid to CP ( deposit + balance ).

 

To avoid such loss of the deposit or even of the full balance already paid, CP strongly recommends that you sign an adequate travel insurance before departure.

3. risks, health & responsibility

Acknowledgement of Risk. You understand and acknowledge that your  participation in a  hiking tour arranged at your request by CP may involve risk and potential exposure to injury. You also recognize and acknowledge that risks and dangers may a arise from foreseeable and unforeseeable causes, including weather and other acts of nature.
 You also acknowledge that the aforementioned risks, dangers and hazards are always a potential in connection with outdoor recreational activities such as CP  hiking tours.

 

Health & Responsibility. In recognition of the inherent risk of hiking tours and related activities, you confirm that you are physically and mentally capable to participate in such tour activity, and that you are willingly and knowingly electing to participate
 in a CP hiking tour in spite of potential risk of danger, and you willingly and voluntarily assume full responsibility for any injury, loss or damage suffered by you or caused by you.

You understand
 and acknowledge that CP reserves the right to accept or reject any participant for any reason, and that CP guides have the right 
to disqualify you from any tour activity, if in the CP guide's judgement, you are incapable of that activity and / or your continued participation in the tour will endanger your health or the safety of the group. It is your responsibility and obligation to inform CP at the time of your reservation of any medical or physical disability or limitation that might disable you or render you unable to perform or safely complete the tour or any activity on the tour. You further acknowledge that you are the best judge of your own conditions and limitations and that it is incumbent upon you to fully disclose the full content of any such conditions or limitations to CP.

A tour member's responsibilty to CP and to other tour members includes ...

· 1) To be sufficiently healthy and to attain the proper fitness level to undertake the tour

· 2) To prepare for the tour by reading ALL of the pre-departure information provided to you by CP


·3)  To bring along the appropriate footwear, clothing and equipment

·4)  To act in an appropriate and respectful manner in accordance with local customs and laws of the region visited

· 5) CP recommends that you  should sign an adequate travel insurance covering injury, illness, death, loss of / damage to                personal property, tour cancellation, and liabilty)

4. privacy policy

CP's Privacy Policy sets out what information we collect, how we collect it, and what we do with it. If you have any questions or would like additional information on this subject, please feel free to send your eMail to info@camino-partners.net

 

As a tour operator, CP may collect non-public personal information directly from our customers. We define "personal information" as information that is unique to an individual and might include the following data: name and surname, contact details, travel preferences and special needs / disabilities / dietary requirements that you supply to us, including any information about other persons on your booking. You are responsible for ensuring that other members of your party are aware of the contents of our Privacy Policy and consent to your acting on their behalf in all dealings with us.

 

For the purpose of providing you with our services , including transportation, hotel accomodation etc , we may need to disclose and process your personal information for administrative reasons. We will use your personal information only for the purposes described, and we will not sell, license, transmit, disclose this information outside of CP unless, a) you expressly authorise us in writing to do so, b) it is necessary to allow our service providers or agents to provide services to us, c) in order to provide our services to you ( and contacting you when necessary ), d) it is necessary in connection with other business purposes including, without limitation, customer care,, business management, risk assessment, security, fraud and crime prevention,, dispute resolution, credit checking and debt collection, or e) we are required or permitted by law.

 

Photo Gallery. During our tours, photos will be made by yourself, by CP, and by other team members. At CP we will collect these photos and provide them f.o.c. to all members of a particular tour via a web link. CP will upload some of these photos to the website's ( public ) Photo Gallery, making sure that all photos being shown are in general respectful and appropriate, respectful of people's personal requests, and of good taste. Photo gallery visibility: being of public access, anyone can visit the CP website and see the photos which have been posted. If you do not agree that photos showing you are posted here, you may ask us to refrain from sharing these photos and personal information ( name, surname, when and where taken ) in CP's photo gallery.



eCorrespondence. We may from time to time contact you with information on offers and forthcoming tours and events, and we assume you will agree to such eComunications when you make a booking with CP. If you do not wish to receive such information, please let us know and CP will discontue this kind of  communication  with immediate effect.

 

We appreciate your questions and comments about our services and welcome your eMail messages to mailboxes mentioned on our website. If there are issues, we will address them as quickly as possible. We will keep a copy of your message until we have had an opportunity to settle your concerns. We may store your message for a certain, reasonable period of time and it will be discarded when no longer needed,


5. general terms: limitation of liability

With the delivery of the Online Booking Form along with your initial payment of 400,00€ in favour of Camino Partners a contractual relationship is being created between CP and you, the particpant in a CP tour package; to fully complete your online reservation, it is necessary to check the box on the Online Booking Form below, confirming your acceptance of CP's Legal Policies.

CP purchases bus and taxi transportation, hotel accomodation, restaurant services and other services from different suppliers which are not subject to its control. CP shall not be held liable for any act, default, injury ( including death ), loss, expense, damage, delay, deviation, curtailment or inconvenience caused to or suffered by any person or their property, which may occur howsoever arising. In purchasing tickets for transportation and making arrangements for hotel or other accomodation, CP is not acting as principal but only as agent for the companies or persons providing means of transportation and accomodation. Further you understand that CP neither owns nor operates such third party suppliers, and accordingly, you agree to seek remedies directly and only against those suppliers and not hold CP responsible for their acts and omissions. CP will not be responsible in no event for incidental, consequential or special damage or loss suffered by any person. CP's maximum liability, for any reason whatsoever, will be limited to the anmount paid to CP for its services.

Without limitation, CP is not reponsible for any negligent or willful acts of 3rd parties or force majeure ( acts of God ), weather emergencies, breakdown or failure of mechanical equipment, government actions, inclement weather, sickness, attacks by animals, availability of medical 
care or the adequacy of the same, criminal activity of any kind, terrorism, war, civil disturbance, sanitary conditions, quality or sanitation of food, quarantine, customs,regulations, epidemics, strikes, safety and/or security standards at hotels or other accomodations, or for any reason beyond control of CP. You understand, agree with, and agree to be legally bound by the terms of the released waiver of liability set forth herein.

Jurisdiction. Only Spanish laws apply. For any legal dispute which may arise from this contractual relationship, both parties expressly submit themselves to the exclusive jurisdiction and competence of the courts and tribunals of Barcelona.
